Agreement to Terms

These Terms and Conditions of Use (the “Terms of Use”) apply to the Go Squared web site located at http://www.gosquared.com, and all associated sites linked to www.gosquared.com by Go Squared, its subsidiaries and affiliates, including Go Squared sites around the world. Go Squared is the property of Go Squared Ltd. BY USING GO SQUARED, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE, DO NOT USE GO SQUARED.

Your Square(s)

A Square, according to Go Squared, is an area of screen real estate measuring 140 pixels in width by 140 pixels in height containing media in the form of images [including gif, jpeg, and png]. Advertisement may also take the form of text.

In purchasing a Square from Go Squared. you agree that you will not under any circumstances display in your Square: pictures, videos, text, audio, or any media that could be seen as inappropriate, offensive or harmful to any other persons who use or view the the Square. If any such content is discovered, and/or any links to 3rd party websites containing, featuring or associated with such content are discovered, Go Squared reserves the right to remove and cancel your Square subscription at any time without notice. A punishment may be issued corresponding to the breach in the Terms of Use of the Go Squared Site. Such punishments may include, but are not limited to, the suspension or removal of the individual's account. In the event of a Go Squared Terms of Use breach resulting in cancellation/suspension of service, a refund is highly unlikely and will be reviewed on a case by case basis.

Users of Go Squared must also note that any files uploaded that are more than 200KB in size will not be accepted by Go Squared and will therefore not be shown.

If any user, member, or onlooker attempts to harm Go Squared, the information that is owned by Go Squared, the users that utilise Go Squared for its agreed purpose, or affect Go Squared in any way, they will be banned from using Go Squared. Their membership will be deactivated which could result in any outstanding monetary sums relating to that user by Go Squared Ltd becoming void. In the event of a breach, Go Squared will take the utmost care to protect its associates from any breach of site Terms of Use. In the event of a breach of security of Go Squared, we will do our utmost to resolve the situation as soon as possible. However, in such a scenario we do not accept responsibility for any changes in site content on The Go Squared Network until full control is regained.

Content

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively known as “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on Go Squared is owned, controlled or licensed by or to Go Squared, and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.

Except as expressly provided in these Terms of Use, no part of Go Squared and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without Go Squared’s express prior written consent.

You may use information on Go Squared products and services (such as data sheets, knowledge base articles, and similar materials) purposely made available by Go Squared for downloading from Go Squared, provided that you (1) do not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) not make any additional representations or warranties relating to such documents.

Purchases; Other Terms and Conditions

Additional terms and conditions may apply to purchases of goods or services and to specific portions or features of Go Squared, including contests, promotions or other similar features, all of which terms are made a part of these Terms of Use by this reference. You agree to abide by such other terms and conditions, including where applicable representing that you are of sufficient legal age to use or participate in such service or feature.

If there is a conflict between these Terms of Use and the terms posted for or applicable to a specific portion of Go Squared or for any service offered on or through Go Squared, the latter terms shall control with respect to your use of that portion of Go Squared or the specific service.

Go Squared’s obligations, if any, with regard to its products and services are governed solely by the agreements pursuant to which they are provided, and nothing on this Site should be construed to alter such agreements.

Go Squared may make changes to any products or services offered on Go Squared, or to the applicable prices for any such products or services, at any time, without notice. Go Squared makes no commitment to update the materials on Go Squared with respect to products and services. Such materials in respect to Go Squared's products and services may be out of date.

In order to pay for a purchase on Go Squared, a third party is used for receipt of such a payment. Go Squared do not accept any responsibility in the event of a breach of any personal details resulting from that company. Go Squared also takes necessary precautions in ensuring that the payment has been completed before our service commences.

Links to Other Sites and to the Go Squared Site

The Go Squared Site may contain links to other independent third-party Web sites (“Linked Sites”). These Linked Sites are provided solely as a convenience to our visitors. Such Linked Sites are not under Go Squared’s control, and Go Squared is not responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on such Linked Sites. You will need to make your own independent judgment regarding your interaction with these Linked Sites.

The GoSquared Site service

Upon signing up to ‘Earn with Go Squared’, you enter a contract of which you must fulfil. This includes adding relevant code to your website in order for ourselves to track relevant and essential information enabling us to provide the best level of service for our customers. It also includes adding the code given to you for the addition of Squares on to your site. You are free to locate squares on your site as you please, but be aware that location in a desirable position is advisable. You must add all relevant code to your site before you can start to ‘Earn with Go Squared.’ By signing up, you must fulfil your commitment by adding such code to your site. Without doing so, Go Squared may deem it necessary to end any contract and/or commitment to your site. If you are found to still be signed up to our ‘Earn with Go Squared’ service but do not have such relevant code on your site, this may result in a termination of any contract along with any money value outstanding to yourselves. Action to such breaches of contract will be judged on a case by case basis and will often involve prompting before any real action is taken.

Go Squared Ltd do not deem it acceptable to end an ‘Earn with Go Squared’ contract whilst existing squares have been purchased by other Go Squared members for exhibition on a particular site signed up to an ‘Earn with Go Squared’ program. All contracts must be fulfilled before an ‘Earn with Go Squared’ contract can be ended. In the event of a breach to this requirement, Go Squared may deem it necessary to refund members who have purchased squares on such a site with credit due to be paid to the site in question. However, this will be reviewed on a case by case basis.

In the unlikely event of a site becoming inactive due to technical reasons & server trouble for extended periods of time, Go Squared will take necessary actions in refunding members who have purchased squares on such a site. This could involve a complete refund, a partial refund or an extension of time as we see fit. Go Squared reserve the right to force upon such compensation in the event of non cooperation. Whilst Go Squared take the utmost care to provide our service 24/7, there may be occasions where the site experiences inactivity for reasons beyond our control (i.e. technical issues) or in the event of scheduled maintenance. Whilst disruption from such maintenance will be kept to an absolute minimum, Go Squared may deem it fit to compensate for extended periods of downtime in the unlikely event that this occurs.

Any code given to our associates through the ‘Earn with Go Squared’ scheme remains the property of Go Squared Ltd. It is strictly forbidden to edit or tamper with such code and/or use it for any purpose other than for what it was intended. It is strictly forbidden for a website to pass on such code to other parties. Such code can only be used with the permission of Go Squared Ltd, available through the Go Squared website only. Misuse of any of our code will result in severe penalties.

Go Squared reserves the right to make and implement changes to any of its code. In the event of this occurrence, associates on the ‘Earn with Go Squared’ scheme will be notified of any changes and expected to update their sites with the new relevant code. Failure to do so could result in sanctions being made and loss of contract.

Whilst the collection and publication of site statistics from sites signed up to the ‘Earn with Go Squared’ scheme attempts to be as accurate as possible, such information is only intended for guideline purposes and hence, may not be 100% accurate.

Feedback and Information

Any feedback you provide at this site will be deemed to be non-confidential. Go Squared will be free to use such information on an unrestricted basis.
